Terms of Service

By using our service you agree to these terms.

No spam

We will not use your email address, if given, to send you unsolicited advertisement. Additionally, we will not sell or give your information to any other company or person, except at your request, or as required to provide the services you have requested (for example, we must provide your addressing information to the USPS to send your backup media).

Payment before service

You agree that our service to you is to be rendered after payment has been received, and that our storage of your data is limited to one year from receipt of your data or four months after receipt of your most recent full monthly payment, whichever is less. For this purpose, an annual payment is considered to be 12 full monthly payments at monthly intervals.

No illegal activity

You agree that the data you send is not illegal in the states of Alabama or Delaware, or evidence of activity which is illegal in those jurisdictions. You agree that if we discover that you are in violation of this provision, we will contact and fully cooperate with the appropriate law enforcement agency or agencies.

No denial of service

You agree not to perform or cause to be performed any "flood" or "denial of service" attack on our systems or facilities, or on that of our customers.

Confidentiality

You agree that should you, through an error by us or our client, come into possession of information which you did not originate, you will turn over this information to us immediately, or destroy it, at our option. Further, you agree that you will not use this information, if obtained, in any substantial business decision or activity, sell, reuse, or transmit this information or a copy to any other entity, or retain a copy.

Indemnity

You agree that you will hold us harmless for any loss except that specifically caused by a failure on our part to provide the backup service, and limited to the data sent to us by you. In the event of a loss of your data in the mail, our liability will be limited to providing new media, either by mail or personally delivered, at our option.
